Thank you for visiting openhouseinsurance.com and its associated websites (collectively, the “Website” or the “Services”), which is owned and operated by Frontline Insurance Managers Inc. (“Frontline”), together with its affiliates and subsidiary companies (collectively referred to herein as “OpenHouse”). OpenHouse provides property and casualty insurance services, including issuance of insurance policies, to customers.

OpenHouse recognizes the critical importance of maintaining and respecting your privacy as a customer or user of our Website. As a result, OpenHouse has established this Privacy Policy (hereinafter, the “Privacy Policy”) to share important information about how OpenHouse collects, uses, shares and protects non-public personal information that may be provided to us through the Website, and your rights with respect to our handling of such personal information about you. This Privacy Policy sets forth and describes the privacy practices of OpenHouse with respect to the Website, and how we process your personal information in order to make the Website available to you.  This Privacy Policy also applies to OpenHouse’s and Frontline’s use of certain Personal Information (as defined below) collected by us or provided by you in connection with our insurance products and services, as described in the “Insurance Services” section set forth below.

Throughout the Privacy Policy, the terms “we,” “us,” and “our” refer to OpenHouse, and the terms “you” and “your” refer to you, as a visitor to the Website, as well as any other visitor to or user of the Website., including, but not limited to, visitors and users that are Insured Parties, authorized producers or agents of OpenHouse Customers, OpenHouse vendors or each of their respective Authorized Employees (as defined herein).

This Privacy Policy is intended to help you understand the types of information we may collect from you or that you may provide when you visit the Website, and describes our practices for collecting, using, maintaining, protecting, and disclosing such information. This Privacy Policy applies to information we collect on or through the Website, and does not necessarily apply to or govern our handling of information collected from you in any other manner.

 

Consent

By accessing the Website or providing any information, including Personal Information (as defined below) to OpenHouse, including submitting information to OpenHouse for the purpose of considering, applying for or using any of the OpenHouse products or services (including insurance policies) made available through the Website or otherwise by OpenHouse (collectively, the “Services”), or submitting Personally Identifiable Information (as defined herein)  to OpenHouse through the Website or by email, text message or other electronic messages between you and the Website, you hereby: (i) agree to the terms of this Privacy Policy; (ii) expressly represent, warrant, and covenant that you have authorization to use and submit such Personal Information to us through the Website; and (iii) expressly consent to the processing of the Personal Information in accordance with this Privacy Policy and applicable law. 

Information gathered through the Website may be transferred, used, and stored in the United States or in other countries where our service providers or we are located.  If you use the Website, you agree to the transfer, use, and storage of your Personal Information in those countries. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. You agree that all transactions relating to the Website are deemed to occur in the United States, where our servers are located.

You may choose not to provide certain information to us, but as a result, you may not be able to use certain features and functionalities of the Website. Notwithstanding anything to the contrary herein, this Privacy Policy does not change or alter the terms of any other contract, policy, or agreement between you and OpenHouse. Collection of Your Information

When you use the Website, we may collect Personal Information from you including but not limited to your contact information (e.g. your first and last name, telephone number, and/or e-mail address), and other information that can identify or be reasonably linked to you, such as your IP address and unique device ID numbers (collectively, “Personal Information”).  If you choose to use our Website to request a quote related to our Insurance Services (as defined below), we may collect additional types of Personal Information (from you as well as from other sources) for the purpose of offering our Insurance Services to you (“Insurance-Related Information”), as further described in the “Insurance Services and Insurance-Related Information” section below.

You may choose not to provide Personal Information (subject to the controls offered by your device’s operating system), but this may prevent you from using or accessing certain features of the Website or from obtaining Insurance Services from us.

We also collect non-Personal Information relating to the Website, that is, information that does not personally identify an individual.  The non-Personal Information we collect includes how you interact with the Website, information generally collected or “logged” by Internet websites or Internet services when accessed or used by users, and information about your web browser or device accessing or using the Services.

Examples of the non-Personal Information we collect are:

  • The pages of our Website that you viewed during a visit;
  • What information, content or advertisements you view or interact with using the Website;
  • Language preferences;
  • The city and state in which you are located (but not your precise geographic location); and
  • Unique identifiers that are not connected and cannot reasonably be connected to your identity.

 

We will not use non-Personal Information to try to identify you, and if we associate any non-Personal Information with information that personally identifies you, then we will treat it as Personal Information. As discussed in more detail below, we sometimes use cookies and other automatic information gathering technologies to gather non-Personal Information.

Information collected by the  Website may be collected by us or one of our service providers.

 

Insurance Services and Insurance-Related Information

Through the Website, we provide a platform that allows individuals or entities insured under an insurance policy or policies provided by or through OpenHouse (“Insured Party” or “Insured Parties”), or that may be otherwise interested in or applying to become an Insured Party, to: (i) obtain information about the insurance policies provided by or through OpenHouse; (ii) submit certain information to obtain quotes and/or apply for property insurance in particular states, as well as other types of insurance offered by OpenHouse, as applicable; (iii) review and manage, and submit payments in connection with such Insured Party’s property insurance policies with OpenHouse, link additional OpenHouse policies to their accounts, and submit insurance claims; (iv) to request changes to insurance policies, obtain and submit policy-related information and documentation (including insurance policy applications, and quote requests), to receive messages from OpenHouse, and to review, track, and/or manage quote requests, application submissions, issued policies, policy renewals, claims status, and other policy-related information (the foregoing (i)-(iv), collectively, the “Insurance Services”).  Insurance Services may also include:

  • Creating and servicing customer accounts, transactions, payments, billing, and inquiries about our products/services and third-party products/services;
  • Providing and optimizing our products/services, respond to your communications, conduct surveys, and satisfying our contractual obligations to you;
  • Marketing and advertising products/services from OpenHouse and Frontline to you through targeted marketing and communications;
  • Performing analysis, reporting, and research of consumer usage patterns and combining or organizing the resulting data to inform our business decisions;
  • Protecting against illegal, fraudulent, and unauthorized activities; investigating user behavior to identify nefarious intent and provide reasonably safe and secure access to our products/services;
  • Improving the quality and performance of our platform and products/services;
  • Ascertaining the identity of users and verifying the eligibility of users to create accounts, apply discounts, determine rating, and confirm payment information;
  • Determining the precise calculation of taxes, fees, or other relevant requirements due to applicable law;
  • Fulfilling applicable legal and regulatory obligations, including but not limited to cooperation with law enforcement or other regulatory interests and requests;
  • Ensuring compliance with OpenHouse and Frontline policies, terms and conditions, and other relevant agreements; and
  • Defending against and/or initiating claims, disputes, and litigation.

 

We use Personal Information and Insurance-Related Information for the purposes of providing the Insurance Services.  Insurance-Related Information that we collect about you can include, without limitation:

  • Information regarding your credit score;
  • Information regarding your prior losses as related to your property insurance coverage;
  • Information regarding your coverage choices as you pick an insurance policy;
  • Co-applicant information;
  • Additional insured information;
  • Effective policy date;
  • How long you have lived at your current address, and whether that address is a new home;
  • Mortgagee information;
  • Additional interest information;
  • Prior insurance information;
  • Agreement to disclosures;
  • Applicant signature;
  • Documents as related to self-inspection requirements;
  • Photos of items/objects related to the insurance self-inspection;
  • Details/items related to claims;
  • Documentation required as related to products/services;
  • Your purchase history of our products/services;
  • Recordings and transcripts of communications between you and the OpenHouse team;
  • Reporting on usage of services/products (product modifications, opt-in/outs, claims frequency, etc.); and
  • Geolocation information.

 

We collect Insurance-Related Information directly from a variety of sources, including, without limitation:

  • Information that we receive from you on applications for insurance or other forms;
  • Information about your transactions with us, our affiliates, or others, such as your account balances, payment history, and account and claims activity;
  • Information that we receive from consumer reporting agencies, such as credit bureau reports (as further described below);
  • Information that we may receive from your insurance agent;
  • Information we collect automatically through the use of our website, products/services, and engagement with our advertising and marketing materials;
  • Information collected in conjunction with our third-party data sources and service providers; and
  • Information that we extrapolate about you based upon your Personal Information and Insurance-Related Information (which we use to determine your preferences through the collection and aggregation of the Personal Information and Insurance-Related Information that we collect).

 

Consumer Reports; Credit-Based Information. In connection with the Insurance Services, we may obtain Personal Information and Insurance-Related Information about you from our affiliates and non-affiliated third parties through use of information you provide through the Website in accordance with this Privacy Policy, which may include, but is not limited to, consumer reports. We may request information about your credit and claims history from a consumer reporting agency. We may also review such consumer reports containing credit-based information, including by obtaining or using a credit-based insurance score based on information contained in your consumer report, provided that our doing so is in accordance with applicable law. By using or requesting the Insurance Services through the Website, you authorize us to request your consumer report and/or obtain other information about you, which may include some Personal Information and Insurance-Related Information. We may also obtain information about your home or property from third parties, including third party vendors specializing in collecting data about property insurance risks. We may combine information that we collect from you through the Website with information that we obtain from such third parties and information derived from other products or services we provide.

 

Disclosures of Insurance-Related Information

We may disclose your Insurance-Related Information (as well as Personal Information) to:

  • Our Affiliates.  Our affiliates are a family of companies including First Protective Insurance Company, PWC Financial, Inc., and Frontline Insurance Managers, Inc.  Affiliates to which we may disclose Insurance-Related Information (as well as Personal Information) about you are in the business of servicing, processing, or administering insurance operations such as underwriting, policy administration, and claims handling, or may be involved in marketing products or services, regulatory compliance, the detection or prevention of fraud, or as otherwise required or allowed by law. These disclosures may be made without prior authorization from you, as permitted by law.
  • Non-Affiliated Third Parties.  In conducting our business, we may disclose Insurance-Related Information (as well as Personal Information) about you to other parties, such as insurance agents or brokers, property appraisers, auditors, claim adjusters, reinsurers, third-party administrators, service companies that maintain and process customer data including those who provide us with information for the purpose of underwriting your policy and offering you a quote, and governmental bodies such as the Florida Department of Financial Services and the Florida Office of Insurance Regulation.  OpenHouse and Frontline may also disclose your Personal Information to advertising and marketing service providers who assist OpenHouse and Frontline with the delivery of marketing messages to you which are connected to the servicing and processing of your insurance policy. OpenHouse and Frontline may also disclose Insurance-Related Information (as well as Personal Information) to nonaffiliated parties in accordance with applicable law.
  • Joint Marketing Service Providers.  OpenHouse and Frontline may disclose Insurance-Related Information (as well as Personal Information) that we collect to insurance agents and brokers so that they can market financial products and services, and to service providers that perform services for us. Any such disclosure is required to be subject to an agreement with us that includes a confidentiality provision. We do not now disclose Insurance-Related Information (as well as Personal Information) to other financial institutions with which we may have joint marketing arrangements; however, we reserve the right to do so in the future, subject to the other institution entering into an agreement with us that includes a confidentiality provision.

 

We do not disclose Insurance-Related Information or other nonpublic personal information about our customers or former customers to anyone, except as otherwise described in this Privacy Policy and as permitted or required by law. We restrict access to Insurance-Related Information about you to those employees and representatives who need to know that information to provide products or services to you, including employees of Frontline and OpenHouse and their affiliates, and non-employees performing business functions necessary to service or process your insurance policy on our behalf. Frontline and OpenHouse maintain physical, electronic, and procedural safeguards that comply with federal rules to guard your Insurance-Related Information.

 

Website Services and Other Services

In addition to the Insurance Services, we may also use your Personal Information, as well as non-personal information that we may collect from time to time, in order to operate, maintain, and improve the Website and our services, and to provide you with other services that we may offer on or through the Website from time to time. Please note that certain types of information you provide, or that we may request, are required in order for us to provide the Services to you. If you do not provide us with such information, or if you ask us to delete that information, you may no longer be able to access or use certain Services.

Personal Information may be collected from you for the purpose of:

  • Providing authorized users of the Website (e.g. Insured Parties, agents, producers, vendors, etc.) with a username and password to access specialized portions of the Website customized for the applicable users’ personal and private use
  • Contacting you to respond to inquiries related to the Website Portal
  • Communicating with you in connection with feedback or other messages you submit to us;
  • Communicating with you to provide you with relevant information about OpenHouse and the products and services OpenHouse and its affiliates offer, including but not limited to, pricing, special promotions, and discounts.
  • Performing research and analysis aimed at improving our products and services and developing new products or services; and
  • Managing and maintaining the systems that provide the Website.

 

In all cases where information is provided directly by you to us, we will collect Personal Information from you only if you voluntarily submit such information to us.  Further, you agree that we may contact you based on the information you provide, as further described in this Privacy Policy, below.

 

The Website Is Not Intended For Use By Individuals Under 18 Years of Age

No one under the age of eighteen (18) may provide any information, including but not limited to Personal Information, on or through the Website. We do not knowingly collect information, including Personal Information, from anyone that we actually know is under the age of eighteen (18). If you are under 18, do not: (i) use any information on, or provide any information to, the Website or, use any information on or through any of the features available on the Website; (ii) use any interactive features on the Website; or (iii) provide any information about yourself to us, including your name, address, telephone number, e-mail address, or any screen name or user name you may use. If we learn that we have collected or received personal information from an individual under 18, we will delete that information at our sole discretion. Security of Information

You must protect against unauthorized access to any information that you use in connection with the Website, and you should remember to close your web browser when you step away from your computer and when you have completed your activities on the Website. If you choose to create an account on the Website (an “Account”), such as an Account for access to the Website, you must treat your user name, password, or any other piece of information related to your Account (“Account Information”) as confidential, and except as otherwise stated herein, you must not disclose Account Information to any other person or entity.

You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. You also agree to ensure that you exit from your Account at the end of each session. Users should refrain from accessing the Website from public or shared computers, and should only access the Website from a personal computer located at the user’s private home or office. When accessing other parts of the Website, you should use particular caution when logging into and viewing your Account, and when submitting Personal Information through the Website using public or shared computers so that others are not able to view or record your password or other information on your Account or otherwise.

We utilize reasonable information security measures to safeguard your Personal Information against unauthorized access, modification, or destruction.  For example, we utilize Secure Socket Layer (SSL), Transport Layer Security (TLS), or similar encryption technology when sensitive data is transmitted over the Internet, and use firewalls to help prevent external access into our network.  However, unfortunately, no data transmission over the Internet can be guaranteed to be absolutely secure. As a result, while we strive to protect Personal Information you submit to us, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk. OpenHouse disclaims any liability, financial or otherwise, associated with the loss or misappropriation of your Personal Information due to authorized access that is beyond OpenHouse’s control.

 

Disclosures of Information

We may disclose your Personal Information to third parties as described below.   

We may disclose Personal Information to provide the Services, or when you authorize or instruct us to do so, for example when you use the Services to submit content or profile information.  We may also disclose Personal Information and non-Personal Information to Service Providers.  By “Service Providers” we mean companies, agents, contractors, service providers, or others engaged to perform functions on our behalf (such as processing of payments, provision of data storage, hosting of our website, marketing of our products and services, and conducting audits).   When we use a Service Provider, we require that the Service Provider use and disclose the Personal Information and non-Personal Information received from us only to provide their services to us or as required by applicable law.  Moreover, when you make a payment to OpenHouse through the Website, your payment transaction may be processed by one or more third-party payment service providers contracted by OpenHouse (each a “Third-Party Processor”). In processing such orders or payment transactions, the Third-Party Processor will collect certain Personal Information, including your name, telephone number, e-mail address, billing information (credit card number, CVV codes, and expiration date, bank routing numbers, and checking account numbers and/or billing address). Information collected by any authorized Third-Party Processor will be used pursuant to the applicable terms of service and privacy policies made available by and through the Third-Party Processor. Third-Party Processors are not an affiliated party of OpenHouse and OpenHouse expressly disclaims any liability, financial or otherwise, associated with your interaction with any Third-Party Processor or use of their payment processing services in violation of each Third-Party Processor’s respective independent terms or privacy policy. You agree to abide by each applicable Third-Party Processor’s terms and conditions required for use of the payment service or Third-Party Processor’s website. In addition, some of our Service Providers will collect information directly from you and provide us with relevant data. We may use this information to carry out our obligations or enforce our rights. Information collected from Service Providers is governed by their own applicable privacy policies. You should view the privacy policies of Service Providers before providing information to them.

We may also disclose Personal Information and non-Personal Information to Online Tool Providers.  By “Online Tool Provider” we mean a licensor of software that we include in, or use with, the Services, including an API or SDK, that provides a specialized function or service to us and that requires the transmission of Personal Information and/or non-Personal Information to the Online Tool Provider.  Online Tool Providers may have the right to use Personal Information and non-Personal Information about you for their own business purposes.  Use and disclosure of Personal Information and non-Personal Information by an Online Tool Provider is described in its privacy policy.  See below for some of the key Online Tool Providers we use.

We may partner with advertisers to provide you with special offers, or to advertise products or services to you.  If you redeem or respond to an offer, we may provide certain Personal Information to the advertising partner.  If you answer questions or fill out surveys from an advertiser, we may share information with that advertiser. The advertising partner’s privacy policy will govern their use of your information, which may include marketing of other products or services to you.  You should read each advertiser’s privacy policy before providing information to that advertiser.

Except as provided in this Privacy Policy, or as otherwise permitted or required under law, we reasonably attempt to ensure that we do not intentionally disclose any Personal Information submitted by you through the Website to any third party without having first received your permission (through your opting in or otherwise agreeing to the disclosure of such information). Notwithstanding the foregoing, we may aggregate and/or de-identify information collected through the Services, and we may use such de-identified or aggregated data for any purpose, including without limitation for research and marketing purposes and may also share such data with any third parties.

We will release information, which may include Personal Information, as required by law to comply with any valid legal or governmental inquiry, request, or process, such as a search warrant, subpoena, statute, or court order. We will also release specific information, which may include Personal Information, in special cases, such as if there is an attempted breach of the security of the Website or a physical or property threat to you or others. We may also transfer user information, including Personal Information, in connection with a corporate merger, consolidation, the sale of related assets or corporate division, or other fundamental corporate change. We may provide access to the Personal Information you submit to us, and other information, to our contractors who are performing services for us in connection with our Website or in connection with the products or services that you have requested.

Additionally, we may use your Personal Information to enforce or apply OpenHouse’s Terms of Use for the Website or any other agreements, including investigating any potential violations thereof, as well as for billing and collection purposes and/or if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of OpenHouse and its affiliates, Customers, or others.  We may also use your Personal Information in order to detect, prevent or otherwise address fraud, security or technical issues.

On occasion, we may collect Personal Information from you in connection with optional special offers or promotions. We will share such information with necessary third parties for the purpose of carrying out the special offer or promotion.  Your participation in the special offer or promotion constitutes your consent to such disclosure and use of such Personal Information.

We also reserve the right to use your Personal Information to send you communications regarding changes to this Privacy Policy or the OpenHouse Terms of Use.

 

Electronic Communications and Opting in and Opting Out

When you communicate with us electronically, via e-mail or otherwise, you consent to our use of the information, including Personal Information, you have provided, and you further consent to receive electronic communications from us.  If you would prefer not to receive such communications, you can opt out of (or “unsubscribe” from) our e-mail lists by clicking on the “opt out”/“unsubscribe” line at the bottom of the e-mail you receive from us.  You should be aware, however, that (i) it is not always possible to quickly remove or modify information in our databases and servers, although we will always make reasonable efforts to do so upon your request, and (ii) we are unable to have your information removed from the records of any third party who has been provided with your information in accordance with this Privacy Policy.

In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of our marketing emails by clicking on the “unsubscribe” link in marketing e-mails or texting “Stop” or “Do Not Send” in response to text messages or disabling notifications in the Services’ settings. Please be aware that there may be a brief period before we are able to process your opt-out.  Some of our Services are available on mobile devices or may utilize SMS/iMessage, which may cause you to incur SMS or data charges with your wireless provider.  Please be aware that we have no control over these charges, and if you do not wish to be charged, you should stop using the mobile or SMS/iMessage features (as applicable).

When you’ve submitted Personal Information to us that includes your telephone number (which submission you understand and agree to constitute making an “inquiry” to us and our affiliated entities), you consent to allow us to contact you or allow our vendors to contact you via telephone for a limited period. You expressly consent to receive phone calls whether or not you are on the Do Not Call list (federal or state). By including your telephone number and/or email address in any submission, you are extending an express invitation and providing your express written consent to us and each vendor you have been matched with (i) to contact you by telephone at the numbers you have provided (including through auto-dialed, pre-recorded, artificial voice, and/or text messages) so we or they may assist you with your transaction, and you hereby consent to any such calls even if your phone number is on any Do Not Call list; and (ii) to contact you by email at any email address you provide. By submitting your Personal Information to us, you are providing your written and signed consent to receive telemarketing calls. You agree that OpenHouse has obtained your consent to receive a prerecorded message sales call in a manner permitted by the Electronic Signatures In Global and National Commerce Act (E-SIGN Act).

As noted herein, we may disclose your Personal Information to third parties in connection with optional special offers or promotions.  You have a right at any time to opt out of such disclosures and to stop us from disclosing your Personal Information for these purposes.  If you would like to opt-out of such disclosures, please contact us at privacy@openinsurance.com.  You should be aware, however, that (i) it is not always possible to completely remove or modify information in our databases and servers, although we will always make reasonable efforts to do so upon your request, and (ii) we are unable to have your information removed from the records of any third party who has been provided with your information in accordance with this Privacy Policy. Further, if you elect to opt-out of such disclosures, it may take up to thirty (30) business days for us to process your request. Additionally, even after you opt-out of such disclosures, to the extent you receive Insurance Services from us, we may still collect, and share your Personal Information in connection with the servicing, processing and administration of your insurance policy, as provided in this Privacy Policy and in accordance with applicable law.

 

Cookies and Other Technologies

Every time you use the Website (e.g., access a webpage) we collect Personal Information and non-Personal Information (discussed above) regarding that use.  For example, to improve our Services, we collect how, when, and which parts of the Website or its features you use.  Also, we may use your device’s unique identifier (UDID) or other unique identifiers to assist us in collecting and analyzing this data.

To assist us in the collection and storage of the foregoing information, the Website may use “cookies” and/or other technologies or files, including but not limited to mobile advertising IDs, web beacons and/or analytics tools from third parties to identify or otherwise to monitor how visitors make use of the Website and to gather operational and behavioral data through your interactions with the Website and related applications, and in communications by email, chat, and/or text message.  A “Cookie” is a small amount of data a website operator, or a third party whose content is embedded in that website, may store in your web browser and that the website operator or, as applicable, the third party, can access when you visit the website.  A Cookie may also refer to web-browser-based storage provided by Adobe’s Flash plugin (a “Flash Cookie”).  A web beacon, pixel or tag is a small, usually-transparent image placed on a web page that allows the operator of that image, which may be the operator of the website you visit or a third party, to read or write a Cookie.

We may also collect information through the use of “Web Beacons” (also known as clear/transparent or single pixel GIFs), which are included in webpages and/or emails and help us understand interactions with webpages or emails, including letting us know which emails sent to you have been opened. Web Beacons can help to let us know which e-mails we send are opened, monitor how long a particular webpage is accessed, and/or perform other functions. Clear GIFs may also see or read cookies on your computer. Additionally, we may leverage UTM and/or URL tracking technologies to understand the effectiveness of digital communication and/or marketing and advertising activity.
